Abstract: Res:O presente texto visa apresentar, numa perspectiva crítica, a Lei das Costas espanhola — seu conteúdo, regulamentação específica e problemas que a respectiva aplicação prática coloca — integrando-a na perspectiva mais ampla do direito do urbanismo e do ordenamento do território espanhóis e, por outro lado, articulando-a com a elaboração de planos de ordenamento do litoral.
Res:This article presents the Spanish Law on coastal zones from the broader perspective of urban and planning Law and linking it with the plans for coastal management. The text also shows how sustainable development comes out from the relations between various public policies: territorial planning, urban planning, environmental protection, social and economic policies. Sustainable development is an objective present in the laws of the Spanish Autonomous Communities and its implementation in the coastal zones highlights the importance of the process of decentralization and distribution of powers between national, regional and local level. In a critical assessment of the urban management practices in the Spanish coastline, the conclusion is that the Law of the Coastal lines was not effective enough in attacking the core problems arising from a disproportionate and unsustainable urban development caused by speculative processes and overvaluation of the soil.
